Proceeding in the OALJ, well you proved your injury or occupational illness happened while working. Piece of Cake! However, dealing in law becomes a problem, because attorneys think, “I went to college to become an attorney and studied the law for years. So, Who do you think you are, enforcing the Law?” Remember to recognize the difference between laws, such as when enforcing The Longshore Harbor Workers' Compensation Act. These laws are opposite to each other, but have somewhat the same meaning Workers’ Compensation, Employee Benefits and Compensation. Be well-mannered, polite but remain affirmative!

After you receive the claims examiner recommendation from the U. S. Department of Labor, your employer may decide to surrender and try to resolve the matter, however this is the time to ask yourself questions?

You have a gut feeling that you do not want to fight this employer, remember this employer took advantage of you, this employer is not your best friend, nor is this employer, your long lost buddy. This employer has now engaged his attorneys to fight you. Now face the employer’s attorneys, as you are their Frick-in nightmare.

Attorneys do unthinkable acts, so do not be surprised.

I could have told you that you can go to the Administrative Law Judge without going to an informal conference with the employer. Depending on the employer (if the employer is honest) you may be able to settle this matter at the informal conference. However, going straight ahead without an informal conference, you just gave the employer’s attorney a defense. This defense he will use is called, “FAIRNESS.” Otherwise you did not give the employer a chance to resolve this matter, without legal steps. “Fairness is a very important process in any legal matter.”
